These terms govern your use of the SportStack website and any services we agree to provide. By using this site or engaging SportStack, you agree to these terms.
Our services
SportStack designs, builds and operates websites and web applications for sport and community organizations. The specific scope, deliverables, timelines and fees for any engagement are set out in a separate written quote or agreement, which takes precedence over these general terms where they differ.
Quotes and fees
Pricing shown on this website is indicative; every engagement is scoped and quoted individually. Fees, payment schedules and any ongoing service charges are confirmed in your quote before work begins.
Your responsibilities
- Provide accurate information and timely feedback so we can deliver your project.
- Ensure you have the rights to any content, logos or data you provide to us.
- Use the services lawfully and not in a way that harms others or the systems we operate.
Data ownership
Your organization's data is and remains yours. You can export it at any time, and we will return or securely delete it on request when an engagement ends, subject to any legal retention requirements.
Intellectual property
On full payment, you receive the rights to the deliverables we create for you as set out in your agreement. SportStack retains rights to its own underlying tools, templates and know-how used to build those deliverables.
Service availability
We work to keep hosted services reliable and available, but we do not guarantee uninterrupted operation. Planned maintenance and any service-level commitments are described in your agreement.
Disclaimer & limitation of liability
The website is provided "as is" without warranties of any kind. To the maximum extent permitted by law, SportStack is not liable for indirect, incidental or consequential damages arising from your use of the site. Nothing in these terms limits liability that cannot be limited under applicable law.
Termination
Either party may end an engagement as described in the applicable agreement. Provisions that by their nature should survive termination — including data ownership and limitation of liability — will continue to apply.
Governing law
These terms are governed by the laws of the applicable province of Canada and the federal laws of Canada that apply there, without regard to conflict-of-laws principles.
Changes to these terms
We may update these terms from time to time. We will revise the "last updated" date above when we do. Continued use of the site after changes take effect constitutes acceptance of the updated terms.
